Terms and Conditions of Service

Please read the following Terms and Conditions completely prior to submitting the form. You must check the box above labeled "I have read and agree to the terms and conditions listed below" to continue with the sign up process.

 a. Design Services. Design services will be performed by AZTech Web Design and will include all services indicated based on the package selected. Upon placing an order, an AZTech representative will be in contact with you, the Client to receive all specific information and to discuss your preferred template or design. All materials provided by you, the Client are and will remain the property of the Client. 

b. Upgrades and Customization. The Client may add an unlimited amount of website upgrades or customization after placing an order. Any additional charges for upgrades or customization must be authorized by the Client and will be quoted above and beyond the orginal price.

c. Domain Name. The Client is and will remain the sole and exclusive owner of the Domain Name. If the Client already has a Domain Name, an AZTech representative will transfer the Client’s Domain name to AZTech's servers free of charge. If the Client wishes to have a Domain Name registered, the Domain Name Registration Fee is included in the orginial price up to and including $20 CAD. The Client’s preferred Domain Names will be discussed and researched for availability during Site Setup and Welcome. All Domain Names will be managed by AZTech Web Design and renewed on the Client’s behalf prior to expiration.

d. Monthly Fee. The Monthly Fee that is indicated for the web design template package will be debited from the Client’s Credit Card on the 15th day of every month. The Client will receive a Sales Receipt each time their Credit Card is debited. The first month for the hosting and support is free and subsequent months are charged at $29.99 per month.  

e. Client Responsibility. The Client is responsible for providing all material that they would like on their website, including but not limited to photo(s) if applicable, text, and Client forms in a modifiable, readable and reproducible format. The Client warrants that all materials provided to AZTech Web Design for the design of Websites are owned or licensed to the Client for use, and may be used lawfully on the Internet. The Client will indemnify and hold AZTech Web Design harmless from any costs, expenses (including reasonable attorney's fees) or liability arising from any claim that such materials infringe the intellectual property rights of any third party or constitute an unlawful or illegal use or violate the rights of any third party.  

f. Technical Support. Unlimited technical support is included with every website package twenty-four (24) hours per day and seven (7) days per week. All support inquiries should be sent to info@aztechwebdesign.com. 

g. Webmaster. The Webmaster link will be placed on the bottom of each Webpage within the Website to allow users to report any technical issues. 

h. Limitation of Liability. AZTech Web Design's maximum liability to Client for any and all losses, claims, damages or liability of any kind (including but not limited to contract or tort) with respect to the services provided by AZTech and any act or omission of AZTech shall be limited to the fees paid by Client, excluding any monthly fees. In no event will AZTech Web Design be liable for any indirect, incidental or consequential damages. 

k. Cancellation. Cancellation of this agreement requires 60 days notice in writing sent. Please send cancellation notices to sales@aztechwebdesign.com or call 250-763-3771. 

l. Default In Payment. Failure to give the required 60 days notice prior to cancellation of this Agreement or any default in recurring fees such as hosting or domain name renewal fees or unpaid invoices for additional services performed, will result in Client forfeiting the domain name, web design, as well as all Client-specific contents included as a part of this Web Design Agreement.  

m. All Sales are Final. Any fees collected are not refundable.
